| Abstract: | This study aims to analyze the guideline for incentive to innovation within the Brazilian public administration - Law No. 14.133/2021 - also known as the New Bidding Law, the paradigm of digital public administration and the development and use of artificial intelligence as a support tool for the internal, external and social control activity of public procurement. As a general objective, this study seeks to investigate the transformations brought by the New Bidding Law and its relation with the paradigm of digital public administration, which fits the technological reality of the 21st century and the uses electronic administrative processes as well as other modern technologies, such as artificial intelligence, to perform constitutional duties. More specifically, the objective is to explore smart systems as a technological innovation aimed at supporting the internal, external and the social control related to public procurement based on the New Bidding Law, analyzing existing initiatives in use by the public administration and society, as well as to evaluate the potential offered by the creation of the National Public Contracting Portal (PNCP) to the process of development and use of artificial intelligence for control purposes. When structuring the research, the deductive method was used, having as main tool the documentary and bibliographic research towards primary and secondary sources. The study is developed in three chapters. The first chapter addresses the innovation incentive guideline within the Brazilian legal system and the advent of the New Bidding Law, which includes the analysis of public contracts as an instrument for inducing potential practices and behaviors in the government and in society, and the obligation of the Brazilian public administration to encourage innovation and the purpose of the New Bidding Law to modernize the legal regime for public procurement. In the second chapter, artificial intelligence is addressed as a bet for technological innovation in the digital public administration model, with an emphasis on the paradigm of digital government, reinforced by Law No. 14.129/2021, also known as the Digital Government Law, on the artificial intelligence and its basic concepts, and on the principles and rules that must be respected when using intelligent systems by the public administration. In the third chapter, artificial intelligence and control of public purchases based on the New Bidding Law are addressed, which includes the analysis of electronic portals and the availability of structured data, control in the digital age and artificial intelligence as a support for control, highlighting the internal, external and social control initiatives in use by the government and society, and the role of the PNCP as the ideal locus for the development and use of this technology. It is concluded that artificial intelligence finds in the New Bidding Law and in the PNCP a favorable environment to be developed and used by the Brazilian public administration and society, due to the tendency that relevant public information for the control of public procurement is more centralized, organized and accessible to the public, which facilitates the implementation of this technology and aligns with the models of digital public administration and government as a data platform. |
